EXEMPTION FROM SUBPARAGRAPH 725.54(1)(a)(i) OF THE AEROPLANE PERFORMANCE OPERATING LIMITATIONS STANDARDS AND SECTION 705.54 OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Canadian Air Operators operating BAE HS-748 aeroplanes, from meeting the requirement of subparagraph 725.54(1)(a)(i) of the Aeroplane performance operating limitations standards made pursuant to section 705.54 of the Canadian Aviation Regulations, subject to the following conditions.

Subparagraph 725.54(1)(a)(i) stipulates that an air operator shall operate an aeroplane in accordance with a contaminated runway operations supplement to the Flight Manual that has been prepared or approved by the manufacturer.

PURPOSE

The purpose of the exemption is to permit operators to continue operating HS-748 aeroplanes using the contaminated runway data that the manufacturer has recently removed from the Approved Flight Manual (AFM), by including this information in the approved company operations manual.

APPLICATION

This exemption applies to all Canadian Air Operators having the HS-748 aeroplane type on their Air Operator Certificate.

CONDITIONS

This exemption is subject to the following conditions:

  1. The contaminated runway performance information previously contained in the manufacturer’s AFM shall be inserted into the approved operator’s company operations manual;
  2. The company operations manual provision that contains the contaminated runway information shall be approved by the Minister;
  3. Bi-annually, the operator shall review the applicable performance data contained in the approved company operations manual for continuing accuracy, relevancy and shall notify the Minister of the result; and
  4. The remaining Commercial Air Service Standards shall be complied with.

VALIDITY

This exemption is in effect until the earliest of the following:

  1. EST at 23:59 March 31, 2008;
  2. the date on which any of the conditions set out in this exemption are breached; or
  3. the date on which this exemption is cancelled, in writing, by the Minister, where he is of the opinion it is no longer in the public interest or is likely to affect aviation safety.
